Terms of Service

By creating an account or using ModelForge ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms govern your use of the Service. If you do not agree, do not use the Service.

2. What the Service Does

ModelForge provides an online platform for creating consistent AI-generated characters and assets from user-supplied text descriptions and reference images. The Service is a tool. It is not an author, photographer, or designer.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older.

4. Account and Credits

Credits are purchased in advance and consumed when generation jobs run. Credits do not expire unless otherwise stated at purchase. Prices are shown before each generation. Refunds are governed by Section 9.

5. Acceptable Use

You may use the Service for personal and commercial purposes. You may not use it to create content that depicts real people without consent, is defamatory, fraudulent, infringing, or illegal.

6. No Mimicking of Real People

The Service is designed for fictional, original characters only. You may not upload reference images of real people without their written consent. You may not prompt the Service to generate likenesses of real or identifiable people. We reserve the right to suspend or terminate accounts that violate this section without refund.

7. Age and Content Restrictions

The Service is strictly safe-for-work. You may not generate sexually explicit, suggestive, or erotically themed content. You may not generate content depicting minors or characters that appear underage. All generated characters must appear to be at least 18 years old.

8. Intellectual Property

You retain ownership of the prompts you write and the outputs you generate, subject to the license granted to us to provide the Service. You represent that you own or have the necessary rights to all reference images you upload.

9. Refunds and Credit Policy

Credits are refundable within 14 days of purchase if unused. If a generation job fails due to provider or platform error, the credits for that job are automatically refunded. No refunds are provided for outputs you simply do not like, provided the generation completed as requested.

10. Payment Terms

Payments are processed through Stripe or other compliant payment processors. Prices are in USD unless otherwise stated. We may change pricing with 30 days' notice.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. AI-generated outputs are probabilistic. We do not guarantee specific visual results, consistency across generations, or fitness for a particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, ModelForge's total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold harmless ModelForge, its founders, and its contractors from any claims, damages, or expenses arising from your use of the Service, your prompts, your uploaded reference images, or your generated outputs.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ends immediately. We will delete your account data within 90 days of termination unless required by law to retain it.

15. Governing Law

These Terms are governed by the laws of Alberta, Canada, and the laws of Canada applicable therein. You submit to the non-exclusive jurisdiction of the courts of Alberta.
